These terms and conditions together with our Privacy Policy or any other policy referred to in these terms and conditions ("Terms") apply to your use of and access to the Website. These Terms will apply to any contract between us for the sale of any product including any order placed by you for any product over the Website.

If you do not agree to these Terms, you must cease using and accessing this Website.

Your use of our Website is governed by these Terms and our Privacy Policy or any other policy referred to in these terms and conditions. You agree that the information you provide when placing an order is true and accurate in all respects. We only use your personal information for the purposes detailed in our  Privacy Policy (eg dealing with orders and accounts, processing payments). You will notify our customer service team of any changes to that information.

Whenever you make use of a feature that allows you to upload content to our Website, or to make contact with other users of our site, you must comply with these Terms and any applicable law.

Any content you upload to our Website will be considered non-confidential and non-proprietary. Garden Gate have the right to use, copy, distribute, reproduce, exploit, modify, alter and/or disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our Website constitutes a violation of their intellectual property rights or of their right to privacy.

We may deny you access to the Website at any time in its sole discretion when we believe that your use of the Website is in violation of any of these Terms, any law or the rights of any third party or was not respectful to others.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site and you hereby agree to be responsible to Garden Gate for and indemnify us and keep us indemnified against all costs, damages, expenses, losses and liabilities incurred and/or suffered by us as a result of any claim in respect of your use of the Website.

Promotional offers 

From time to time, Garden Gate runs promotions and offers on selected products or lines, the terms of which are entirely at its discretion. A full list of the current offers can be found below in the Offers section. As each promotion may have different terms and conditions, you are advised to contact us if you require detailed information about a particular promotion. We refer to these collectively as our "Promotional Offers”.

 

All of our Promotional Offers are subject to the below terms and conditions:

  1. They are only valid on full-priced items and cannot be used on sale or promotional items that are already discounted unless otherwise stated; 

  2. They cannot be used in conjunction with any other offer; They are valid for a limited period of time as specified in the marketing communication on the website or in stores and cannot be used outside of that period: 

  3. Two promotions cannot be applied to the same order and some promotions are restricted to one per customer 

  4. Promotions may have a minimum spend, contact us for further details.

  5. Promotions are not valid in our web outlet store; 

  6. If an item is returned which brings the amount spent below any qualifying level for an offer or promotion, the offer value may be deducted from any refund; and; 

  7. All orders are subject to stock availability and we reserve the right to withdraw, amend or extend offers at any time, without prior notice. 

  8. By using our promotional offers you will be automatically signed up to our mailing list.

 

Orders 

By placing an order with us, you agree to and accept these terms. If you are unhappy with or unclear about any aspect of these terms, please contact one of our customer services advisors on 01798 903292, between the hours of 11am – 16.30pm Tuesday – Friday, or via email on orders@garden-gate.uk  or by post using the address given above. Calls to our Customer Service team are charged at the local rate (BT customers only, other network providers may vary).

By placing an order via this website, you are making an offer to The Garden Gate Boutique to purchase the goods detailed in your order upon the terms described in your order.

By placing an order for the delivery of goods via this website, you are making an offer to Garden Gate to deliver the goods detailed in your order upon the terms described in your order.

Once you have placed an order for goods (and delivery, if applicable), we will send you confirmation that your order has been received, but this is not a confirmation that your offer to purchase the goods (or for them to be delivered) has been accepted. A contract between you and The Garden Gate Boutique for the sale and delivery of our goods will only exist once an order has been accepted, processed and dispatched to you. We will take payment from your Apple Pay/Google pay or via debit/credit card at the time you place your order. This does not affect your legal rights.

Prices and availability of goods are subject to change without notice.

STOCK AVAILABILITY 

We endeavour to display through this Website all items in our current range. We aim to hold stock of all styles whilst a product is active. However, occasionally an item might be out of stock and we may have to advise you of this once your order has been placed. You will be invited to receive a refund the item is not being restocked in a timely manner. 

 

Deliveries 

Please note that a delivery charge will be added to your order value where appropriate. Garden Gate shall receive such delivery charge in relation to the delivery of the goods.

All dates quoted for delivery are estimated delivery dates only and may be subject to change. Garden Gate cannot accept liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.

EU Deliveries 

Deliveries to EU countries will be subject to the following terms and conditions.

By accepting these terms and conditions and requesting delivery within the EU you are making an offer to Garden Gate to deliver the goods detailed in your order upon the terms and charge described in your order. Ownership, title and risk of the goods will pass to you when the goods are placed at your disposal at our UK premises. Prices are exclusive of UK VAT (placeholder for destination VAT). 

 

Conformity of goods 

We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this Website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.

Your right to cancel 

You have a legal right to change your mind and cancel your order within 14 days of receipt and receive a refund of all charges for the cancelled goods and the standard shipping charges in the UK (check for Int?). We will process the refund without delay and in any event not later than (a) 14 days after the day we receive back from you any products supplied; or (b) if there were no products supplied, 14 days after the day on which we receive your cancellation notification.  You will then need to return the item(s) by post. Parcels returned by post are returned at your own cost. Gift cards and E-gift card ("Gift Tender Terms") 

​

Garden Gate gift cards and E-gift cards ("Gift Tender") can be used or redeemed online (subject to website terms and conditions).  

​

Gift Tender may be exchanged for goods the price of which being equal to or lower than the balance or value of the Gift Tender. Gift Tender can be used as a complete or partial payment. If a purchase exceeds the redeemer's Gift Tender balance or value, the remaining amount must be paid with another method of payment. If any item purchased with Gift Tender is subsequently exchanged for an item of a lower price or refunded, any money owing to you will be refunded via the form of Gift Tender originally used for such purchase.

Gift Tender cannot be resold, transferred for value or exchanged for cash. No cash change will be given on purchases made using Gift Tender. Gift Tender cannot be used to purchase other Gift Tender. Gift Tender is not cheque guarantee, credit or charge cards.

Gift Tender cannot be returned or refunded, except in accordance with your legal rights. 

​

Garden Gate shall not be liable or responsible for lost, stolen, destroyed or damaged Gift Tender, or if Gift Tender is used without your permission. The Garden Gate Boutique is unable to replace Gift Tender if lost or stolen. 

​

Garden Gate shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, technical and computer faults, failures and malfunctions or any other circumstances amounting to force majeure. 

​

Garden Gate reserves the right to refuse to accept any Gift Tender (and to take alternative forms of payment) which it deems to have been tampered with, defaced, modified, duplicated, damaged, or which otherwise is suspected to be affected from fraud. 

​

By purchasing, using or accepting Gift Tender you confirm your acknowledgement and acceptance of these terms and conditions. Garden Gate reserves the right to amend these terms and conditions from time to time, without notice and to take appropriate action, including the cancellation of Gift Tender, if, in its discretion, it deems such action necessary. This does not affect your legal rights. Garden Gate is the sole issuer and obligator to you. Garden Gate may assign its issuer duties without recourse.

The remainder of these Terms shall apply to all purchases of goods made using Gift Tender. To the extent that there is any conflict or inconsistency between the Terms and these Gift Tender Terms, these Gift Tender Terms shall take precedence prevailing over the provisions of the Terms. 

​

UK VAT refunds 

UK VAT is not charged on goods exported to a destination outside of the United Kingdom. 0% UK VAT has been applied on these sales, therefore these sales are not eligible for a UK VAT Refund.

Customs and import Duties 

All prices quoted on the Website are accurate at the time of publication, are quoted in pounds sterling and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the United Kingdom (UK) then your UK sales tax (VAT) will be zero.

 

Prices may be shown in  your local currency.

Europe 

From 1st January 2021, orders from EU countries with an order value over €150 will be subject to import duty in addition of local country goods and services tax (VAT). The Garden Gate Boutique pays all import taxes and duties on your behalf, on a delivery duty paid (DDP) basis and this charge is added at checkout.  

From 1st January 2021, orders from EU countries will still be liable for goods and services tax (ie VAT) at your local EU member state rate. Garden Gate will calculate this and pay this on your behalf. The in-country VAT will be shown at checkout.

Garden Gate takes care of all the post-Brexit import, duty and VAT arrangements to make your shopping hassle free. Our carriers will complete all necessary customs paperwork to ensure there are minimal delays with orders from EU countries.

Disclaimer & limitations of liability 

Garden Gate does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, neither Garden Gate nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Garden Gate or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

The limitations of liability in these conditions shall apply equally for the benefit of Garden Gate and any other associated company of Garden Gate as if references to Garden Gate included references to each such associated company.

Copyright and Trademark 

While Garden Gate uses reasonable endeavours to ensure that the information on this Website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Garden Gate will not be responsible for any errors or omissions or for the results arising from the use of such information. While Garden Gate  takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this Website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Laws and Territories 

To the extent it is possible to exclude the application of other laws and regulations, these Terms and your use of our Website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. This Website and our Terms have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this Website or the placing of any order through this Website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

Further, Garden Gate  will not be responsible nor liable for your use of any other Websites which you may access via links within this Website. Garden Gate does not control these Websites and is not responsible for their content.

No person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

We try to make our charges transparent for you. The more you order the cheaper the delivery! Our minimum order value is £30. 
 

Free delivery for large items within a 30-mile radius of our stores (Please ask for quotes outside this radius)

  

UK Standard Delivery (3-5 working days)

  • FREE for all orders over £500.00 (excludes "Pallet" items)

  • £4.95 for orders between 0kg to 5kg (single item)

  • £7.95 for orders between 5kg to 10kg (single item)

  • £12.95 for orders between 10kg to 15kg (single item)

Please check your confirmation email for shipping timeline estimates. Tracking will be emailed to you as soon as your order has been processed to ship.

Please note international orders can be subject to duties and fees imposed by local tax authorities that we are unable to calculate at checkout.


Orders are processed from Monday to Friday from our warehouse in the United Kingdom. Orders placed on bank holidays or weekends will begin processing the next business day. Orders placed after 12pm are processed the next working day. 

 

We can only ship to physical addresses. We are unable to deliver to PO boxes. Don't forget to include a mobile phone number so the recipient can be contacted by the courier company. Unfortunately we cannot be liable for any postal or customs delays.

RETURNS

We want you to be delighted with your purchase, but if not, you can "apply for a return" (orders@garden-gate.uk) within 14 days of receipt, with a further 14 days from the date of your application to physically return the goods at your own cost (unless the item is faulty). We are happy to refund you in full if the products are returned complete, in unused condition, with the original labels and preferably original packaging. 


To apply for a return, please follow the below instructions:

  1. Login to your account

  2. Select the order you would like to submit a return for

  3. If your order has more than one item, select the items you would like to return

  4. Select the return reason and add a note for the store

  5. Click 'Request Return'.

 

We will strive to refund your items, including the original standard shipping cost, within 2 days of receipt. We know how important it is to get your money back expediently. If you would like to receive store credit in the form of a gift voucher, please contact us at orders@garden-gate.uk   

 

We have moved to paperless returns to support our sustainability objectives. Refunds can only be credited back to the original form of payment (even if a gift) and may take 5-10 days, from our receipt of goods, before they show back in your account due to 3rd party (e.g. bank) processing, particularly via ApplePay, GooglePay or Klarna.

We have made the process easier for you with multiple options at different price points. Choose from home collection with discounted rates from our partner Fedex to bringing it to your local Post Office. Generate and pay for a returns label by arranging either a Home Collection or a Drop Off

 

Some alternative services are Collect + , Yodel and Parcelforce

 

A tracked service is recommended and as we cannot accept responsibility for parcels lost or damaged in transit.

FAULTY OR DAMAGED ITEMS 

We are very disappointed on the rare occasions our customers receive a faulty product. If you have identified the fault within 14 days of purchase, please apply for a return at orders@garden-gate.uk, choosing the title “damaged” and attaching photo(s) of the damaged item(s) for our review. Once the return has been approved, you will receive a pre-paid shipping label from us via email.

INTERNATIONAL RETURNS 

We appreciate the inconvenience of an international return.

 

Following Brexit, it is vital to mark your return as “British Returned Goods” on the exterior of the parcel so that exemption from return import duties and taxes is applied. If not, any import duties and/or taxes we incur on return shipments will be deducted from any amounts due for refund to you.

 

We cannot be responsible for goods held by customs or lost in transit.

EXCLUSIONS AND EXCEPTIONS (Faux Flowers)

 

  • Bouquets, Any bouquet that is customised (including cutting it to a non-standard length fit your own vase) may be non-refundable. Please ensure that you do not un-tie your bouquet until you are completely satisfied with it as a re-arranging fee will be deducted from your refund.  

  • Where a bunch is returned that was sold under a “6 for the price of 5” offer, the refund will be for 5 stems.  

  • Multi-stem Arrangements are sold as a set and at a discount to the combined value of all the stems. Returns of individual stems sold as part of an Arrangement may be refunded at the discounted rate to a full price stem.  

  • A restocking fee may be imposed at our discretion for repeat returns, on large orders over £500 and where our flowers appear to have been “borrowed”. Please note to ensure the quality remains pristine for all customers, we do not rent out our flowers.
